LW601 - Diploma Lepasan Ijazah Syariah dan Amalan
Introduction
This is a professional programme designed to train those who are interested in practising in the Syariah Courts and those who want to be Syarie lawyers. Apart from providing hands-on training to students, this programme intends to expose students to several aspects of Syariah Law. It also aims to enhance their knowledge in the different procedures practiced in the Syariah Courts as opposed to the civil courts. Furthermore students will be trained in matters pertaining to Syariah trial and advocacy.

Admission and MQA Requirements
Candidates must have at least one of the following qualifications:
Bachelor of Laws (Hons) or any equivalent law degree from other institutions of higher learning recognised by the Government of Malaysia with a minimum CGPA of 2.00; or
Bachelor of Legal Studies (Hons) from Universiti Teknologi MARA (UiTM) with a minimum CGPA of 2.00; or
Bachelor of Syariah (Hons) or other equivalent Syariah Degree recognised by the Government of Malaysia with a minimum CGPA of 2.00; or
- A Bachelor degree or its equivalent with a minimum of three (3) years relevant working experience
Candidates must achieve a minimum of Band 2 in the MUET for graduation.

Programme Structure

Course Description
LAW619 – ISLAMIC JURISPRUDENCE
This course looks into the principles of Islamic Jurisprudence, particularly views of Muslim jurists on the established and disputed sources of sharia, the issue of abrogation (al-nasakh), contradiction (al-ta’arud), preference (al-tarjih) and the order of the proofs, rules of deducing the law from its sources (istinbat) and the sharia itself.
LAW633 – ISLAMIC FAMILY LAW
This course deals with Islamic Family Law and its administrative problems. Among the areas of study are the family system in Islam, the fundamentals of marriage, the rights and obligations of the husband and the wife, the grounds of dissolution of the marriage, ancillary claims, custodial rights and duties concerning children and the distribution of assets.
LAW634 – ISLAM CRIMINAL LAW
Among the topics to be dealt with in this course are the classifications of offences and the punishments that exist under Islamic Law, together with the practical realities of their application in Malaysia and in other Islamic countries.
LAW635 – MAL PROCEDURE
This course discusses matters relating to civil procedure such as the jurisdiction and the power of the Syariah Court, al-Talab (claims), pre-trial process, wakalah (agency), sulh (settlement) and trials in the Syariah Court, and the final processes of civil litigation relating to judgement, order, appeal procedures and modes of execution.
LAW636 – SYARIE LEGAL WRITING
This course will expose students to the importance of Bahasa Melayu as a legal tool to write and communicate in the Syarie Legal Profession. Among the topics covered are writing official letters, letters of demand, statement of defence, draft questions for civil and criminal trial, report writing and drafting of contracts, submissions to judges and closing speech.
LAW637 – ISLAMIC JUDICIAL SYSTEM AND ADVOCACY
This course deals with the essentials of the Islamic justice system, starting with the concepts and principles of the Islamic judicial system, conditions for the appointment of a judge, his role and jurisdiction and removal of the judge in the Islamic judicial system in Malaysia. It also deals with issues concerning the syarie legal practice, particularly the obligations of a syarie lawyer according to the Quran and Sunnah, the organizational framework of the syarie lawyer in Malaysia, rules of personal and professional ethics of the syarie lawyer, the rights and duties enshrined in the concept of legal representation, fiduciary and professional issues of a syarie lawyer-client relationship and the grounds for disciplinary action.
LAW628 – INDUSTRIAL TRAINING
Industrial training is a curriculum component in the study program that allows students to gain practical experience, soft skills and a positive attitude before facing the challenges of the real career world. Those who completed industrial training during their undergraduate studies or spent more than two (2) years working in the legal profession may be eligible for exemptions.
LAW683 – ISLAMIC LAW OF PROPERTY AND SUCCESSION
This course discusses the concepts of property, ownership and succession in Islam. Among the areas of study are the concept and classification of property, the concept of ownership, the concept of inheritance, distribution of property, the grounds of inheritance, classification of legal heirs, exceptional matters relating to distribution of property and the administration of Islamic inheritance in Malaysia.
LAW684 – ISLAMIC LAW OF EVIDENCE
This course looks into the concept and the application of Islamic Law of Evidence in the Syariah Courts in Malaysia. The evidentiary issues such as the various forms of evidence of al- Iqrar, al-Shahadah, al-Yamin, al-Kitabah, al-Qiranah, together with their applications in the Syariah Courts will be explored in this course.
LAW685 – ISLAMIC CRIMINAL PROCEDURE
This course introduces the various Islamic criminal procedural law devices as practised in the Syariah Courts in Malaysia. Among the topics that will be studied are concepts of criminal procedure, the basic principles of criminal procedure, pre-trial procedure, transfer of cases, trial, judgement, sentences, acquittals, convictions, appeal and revision.
LAW686 – SYARIE TRIAL AND ADVOCACY
The course involves advocacy skills. It covers the practice of preparing for trial for example interviewing skills, discussion, arranging for trial and drafting of pleadings, preparation of questions for examination of witnesses, cross-examination, re-examination of witnesses as well as mitigation.
